What is a property handover in Dubai?
A property handover in Dubai is the process by which a developer officially transfers ownership of a completed off-plan property to the buyer. It involves a property inspection, snagging (identifying defects), signing handover documents, paying any remaining balance, receiving the keys, and initiating the title deed transfer at the DLD.
What should I check during a Dubai property handover inspection?
During the inspection check: walls and floors for cracks, chips, or misalignment; all doors and windows open/close properly; plumbing — run all taps and flush all toilets to test water pressure; electrical — test all outlets, switches and appliances; air conditioning — test all units; kitchen appliances if included; tile grout and finishes; balcony drains; parking space allocation; and building common areas match the sales brochure.
What is a snagging list in Dubai property?
A snagging list is a written record of all defects, incomplete work or damage found during the property handover inspection. You present this to the developer, who is legally obligated to rectify all snags within a reasonable period (typically 30–60 days) under the 1-year defect liability period. Document everything with photos and timestamps.
Can I refuse handover if there are defects?
You can decline to sign the handover documents if there are major structural defects. For minor snags, it's usually better to sign, note the snags in writing, and allow the developer to rectify them — refusing handover for minor issues can delay your title deed. For major issues (missing features, structural problems), consult a UAE property lawyer before signing.
How long is the defect liability period in Dubai?
Under UAE law (Federal Law No. 5 of 1985), developers are responsible for structural defects for 10 years from the date of handover. For non-structural defects and finishes (paint, tiles, fixtures), the defect liability period is typically 1 year as stated in the Sale and Purchase Agreement. Major structural issues have a 10-year liability under the Civil Transactions Law.
When do I get the title deed after handover?
After completing the handover and paying the final balance, the developer initiates the title deed transfer at the DLD. This typically takes 2–4 weeks. The 4% DLD registration fee is paid at this point (if not already paid through Oqood). The title deed (or e-title deed) is then issued in your name by the Dubai Land Department.
